Terms of Use Agreement

Dear all, welcome to our official website, mobile APP, associated software, products or online service (Service) supported by KABOB HOLDING Co.,LTD.薩摩亞商串串控股股份有限公司（Kabob or us）. No matter users have signed up or not, while using this Service in any conditions, it means you have agreed with this Agreement and will adhere all the terms and the occasionally changes by Kabob. This Agreement is for all users, members, viewers, contributors and any individuals that are using this Service.

1. Terms of Use Agreement

• When you enter or use this Service, that means you have agreed with this Agreement. If you don’t agree with this Agreement, please don’t enter or use this Service.
• Once you use this Service, you have agreed with this Agreement.
• If there are other terms, you should adhere those as long as this Agreement.
• Once you agree with this Agreement, it means you have promised that you are legally an adult in your country. If you are over 13 years old and is someone’s parent or legal guardian, you are allowed to let minors use this Service through your account with your supervision and have to adhere this Agreement.
• You agree to use this Service at your own risk. Permitted by law, employees, agents, directors and managers of Kabob and Kabob Co., LTD are indemnified by any promises about this Service and the accuracy and integrity of expansion contents.

2. The modify and change of the Terms of Use Agreement

Kabob has the right to change this Agreement irregularly and without prior inform. If you enter or use this Service after the change of this Agreement, it means you have agreed all the changes. The changed Agreement will be at a proper spot, please read the newest version when you use this Service.

3. Accounts

• The information you provide to Kabob has to be real, correct, complete and newest. You have to sign in with name (if is an enterprise, it requires enterprise name, legal representative and the name of the account manager), address, phone number, e-mail, and the information for payment.
• The account and password of this Service is for you and you only. You are not able to transfer ( inheriting included) or lend to any other third party, unless this Agreement or the condition allows you to.
• If Kabob considers that you have violated or may have violated this Agreement or conditions, Kabob has the right to suspend or delete your user account at any time and without prior warning.
• You are solely responsible for maintaining the security and confidentiality of your user account which you used for signing in this Service to prevent the access without your authorization. Any use by your registration password will be considered your use.
• You can create an account for a team, a juridical person, an enterprise or any organization and be the owner of the account.

4. Restriction

When using this Service, you are expressly prohibited from

• Violation of laws, court decisions, resolutions, orders or administrative restrictions such as legal binding
• Being harmful to public order
• Violation of intellectual property rights including production rights, trademarks and patents, goodwill, privacy. Violating the rights of Kabob and/or third parties based on law or contract.
• ing this Service through illegal paths or means; interference the host of this Service and/or network system; abusing of this Service through robotics, cheating tools or other technical measures; using the defects of this Service on purpose; unreasonable requests and/or claim; interference Kabob to operate this Service.
• Selling, renting, transferring or publishing this Agreement and the power and recognition given by that in any form.

5. User-Generated Content

• This Service allows you to post contents and texts such as personal messages, commercial messages, creative contents (textures, images, photos, videos and audios). You will reserve the ownership of these contents. Once you upload contents to Kabob, you grant Kabob a royalty free, non-exclusive, dividable, transferable and worldwide license. Kabob is able to use, copy, publish, adapt and provide online contents for business use in accordance with the license you submitted and is able to promote and repost included, but not limited in any media form. Kabob will not reserve the contents you removed or deleted in the Service.
• To protect the rights of all users of this Service, some contents are not allowed. You agree not to upload or post these contents to this Service.
  1. （i） Any contents that may cause anyone’s personal property damage or loss, mentally and emotionally damage, death, loss of ability and physical and mental morbidity.
  2. （ii） Kabob supports the freedom of speech and protect users’ rights to express personal opinions, but Kabob does not allow any contents that may increase hatred, start violence and discriminate or bully any individuality or groups.
  3. （iii） Kabob cares about the education and growth of our next generation. Any contents that may cause bad effects to minors are strictly prohibited such as violence, erotic, drugs, abnormal state, bloody, offending public morals and more.
  4. （iv） To create a positive and high quality user environment, any contents that may make others feel uncomfortable are not allowed such as dead bodies and accident scenes.
  5. （v） Any unreal, criminal and illegal contents are not allowed such as extorting, robbing, taking drugs and abusing animals.
  6. （vi） Kabob attaches importance to users’ privacy, any contents that may expose personal information, violate privacy right and disturb others are strictly prohibited. （vii） Any contents that are from illegal sources, content unauthorized third party materials or patents are not allowed.

Kabob reserves the right of non-duty view and the right to deny any improper contents. If your violation of this Agreement is serious, Kabob will take the right to use this Service from you and you cannot create a new account permanently. This Agreement is to protect the rights and the quality of the users of this Service. Please read this Agreement carefully and adhere completely. Hope you have fun in here :)

6. Payment

• This Service includes free and paid parts. If you use the paid part, you have agreed the price that Kabob set and will pay for it. Kabob has the right to adjust the price about this Service anytime and add or attach extra paid service.
• You can terminate your account anytime, but Kabob will not refund you any money. If account is terminated by Kabob by any reason, you will not refund any money.
• All of the Information about your payment and account must be complete, correct and usable. You agree to pay all the cost of using this Service such as royalty payment, transection fee and taxes due to trade with this Service.

7. Termination of use

You can terminate your account and stop using this Service anytime. Kabob also can block, disable, suspend or terminate all or part of the right to use of this Service including the contents without prior warning. The reasons of the termination of use include, but not limited
i.Violation of this Agreement;
ii.Natural disaster;
iii.When you stop paying for the cost of this Service;
iv.legal orders or adhere the legal procedure;
v.Your request to terminate your account;

8. Compensation

You agree to compensate the compensation, damage, obligation, responsibility, cost, debt and expenditure within the law because of the following reasons and make Kabob and all the employees, agents, directors and managers in Kabob suffer no loss. The reasons are
i.Violation of this Agreement;
ii.Violation of include, but not limited copy right, property right and privacy right from any third party;
iii.The allegation of damages from third party because of your contents;

This obligation continues to be effective during and after you use this Service.
